Dad, partner plead not guilty in toddlers compound death


The freaky judicial actions in the case of a New Mexico compound where alleged terrorist training and child abuse was occurring continues to baffle observers.

U.S. Rep. Michelle Lujan Grisham, the Democratic candidate for governor, called the dismissal of neglect charges "inexcusable" and said she was "appalled at the failure to hold these defendants accountable".

Authorities arrested Siraj Wahhaj, Hujrah Wahhaj, Subhannah Wahhaj, Lucas Morten, and Jany Leveille.

The body of a missing three-year-old was found three days later at the compound.

The boy's mother initially reported the boy missing a year ago from Jonesboro, Georgia, after Wahhaj said he was taking the child to a park and didn't return.

Wahhaj was heavily armed when sheriff's deputies executed a search warrant and swarmed the property. Each of the five adults faced 11 charges of child abuse.

Authorities say Wahhaj and Leveille denied the boy proper medicine and health care as he died in December 2017 during a religious ritual aimed at casting out demonic spirits. The children told investigators that Siraj had been training them to conduct school shootings; they also said that they had been ordered to shoot law enforcement in the instance of a raid.

Meanwhile, the father of a toddler found dead at the compound and his partner pleaded not guilty to new charges of child abuse resulting in death the same day.

The case came to prominence earlier in August after concerned neighbors asked authorities to investigate living conditions at the compound, which was a trailer dug into the ground and surrounded by a wall of tires. Now, it appears the state bungled statutory requirements to file documents required to continue the prosecution.

"It sounds like they have a new law in place where it's a very high standard for keeping people in jail awaiting trial, so that played into the release of these individuals", Stein said.

Taos County District Court Judge Jeff McElroy called out prosecutors Wednesday for being incompetent during the arraignment, according to affiliate KOAT. "He says he doesn't know if the office is overworked or what, but he finds it disturbing the state didn't play by the rules. I don't see the district attorney here or the chief deputy district attorney, but it is disturbing to me that the district attorney would put this court in that kind of a situation". Robinson explained the options now facing prosecutors.

Chavez dropped child abuse charges against Lucas Morton, Subhannah Wahhaj, and Hujrah Wahhaj, and a separate judge dropped similar charges against Siraj Ibn Wahhaj and Jany Leveille.
